These Terms and Conditions ("Terms") govern your use of the fomo mobile application and related services (the "Service") operated by fomo circles ("fomo," "we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
You must be at least 18 years old to use fomo. We verify your age through date-of-birth verification during registration. Accounts found to belong to users under 18 will be terminated and the associated personal information deleted.
By using the Service, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not barred from using the Service under applicable law.
You are responsible for maintaining the security of your account credentials. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for unauthorized purposes.
You agree not to use the Service to:
You retain ownership of the content you post on fomo ("User Content"). By posting content, you grant fomo a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.
This license ends when you delete your content or your account, except where your content has been shared with others and they have not deleted it, or where we are required to retain it for legal purposes.
fomo does not use your User Content — your photos, videos, messages, comments, profile, or any other content you create on the Service — to train, fine-tune, or improve any artificial intelligence or machine learning models, whether our own or those of any third party. We do not sell, license, or share your User Content with any AI training provider. This commitment applies indefinitely and survives termination of your account.
The only automated system that processes your media is Google Cloud Vision SafeSearch, which scans uploaded images and video thumbnails for sensitive content for safety purposes only. Google is contractually prohibited from using your content to train its own models under our Cloud agreement. See our Privacy Policy for details.
You are solely responsible for the content you post. We do not endorse or guarantee the accuracy, completeness, or reliability of any User Content.
We reserve the right to remove any content that violates these Terms or that we find objectionable, without prior notice.
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of fomo circles. The Service is protected by copyright, trademark, and other laws.
The fomo name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of fomo circles. You may not use these marks without our prior written permission.
Fliks are designed to be temporary. They are intended to disappear after 24 hours or after being viewed, whichever comes first. However:
You should not share sensitive or confidential information through Fliks with the expectation of guaranteed deletion.
You may terminate your account at any time by deleting it through the app settings. Upon deletion, we will remove your profile and content, subject to our data retention practices described in our Privacy Policy.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
If three or more other users report your account within a rolling 30-day window, your account will be temporarily disabled pending human review and you will be signed out. When you next attempt to sign in you will see a notice explaining the suspension. Reports are counted across all of your posts, thoughts, and your profile, so the threshold applies whether the reports are on a single piece of content or spread across multiple. Only reports filed by other users count toward this threshold — automated SafeSearch flags do not. Multiple reports from the same reporter are deduplicated, and reports older than 30 days age out and no longer count, so reports spread across months or years do not accumulate against your account. If you believe the suspension was issued in error, you may appeal by contacting safety@fomocircles.com.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any content will be accurate, reliable, or complete.
To the maximum extent permitted by law, fomo circles and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.
In no event shall our total liability to you exceed the amount you have paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Dallas County, Texas.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
If you do not agree to the modified Terms, you should stop using the Service and delete your account.
